1. Service Description

PlanEat is a meal planning and organization tool that helps you manage nutrition plans, create grocery lists, and track your meals. PlanEat is designed to assist you in organizing meal plans provided by your healthcare professional or created by you.

2. Health and Nutrition Disclaimer

This is the most important section of these terms. Please read it carefully.

• PlanEat does not provide medical advice, diagnosis, or treatment. PlanEat is not a medical device.
• Nutritional estimates displayed in the app (calories, macronutrients, etc.) are approximate values generated, in some cases, by artificial intelligence. They may be inaccurate, incomplete, or inappropriate for your specific needs. They should not be relied upon for medical, dietary, or health decisions.
• Meal plans created or imported into PlanEat are provided by you or your healthcare professional. PlanEat does not validate, recommend, or endorse any specific diet or meal plan.
• You should always consult a qualified healthcare professional (doctor, registered dietitian, or nutritionist) before making any dietary changes, especially if you have food allergies, intolerances, medical conditions, or specific nutritional needs.
• Assumption of Risk: You use PlanEat entirely at your own risk. PlanEat is not responsible for any health outcomes, adverse reactions, or consequences resulting from following any meal plan or dietary information managed through the app.
• If recipes or food suggestions are displayed, you are responsible for verifying allergen information independently.

3. Acceptance of Terms

By creating an account or using PlanEat, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the app.

4. User Accounts

• You may sign in using Google, Apple, or email magic link via Firebase Authentication.
• You are responsible for maintaining the security of your account.
• One account per person. Do not share your account credentials.
• You must provide accurate information when creating your account.

5. User Responsibilities and Acceptable Use

• You are solely responsible for the accuracy and legality of the data you enter into the app (meal plans, food items, quantities).
• User-Generated Content: If the app allows you to share meal plans or content with others, you agree not to share content that is illegal, offensive, abusive, or violates the intellectual property rights of others. We reserve the right to remove any content or terminate accounts that violate these guidelines.
• You agree to use PlanEat only for lawful purposes.
• You may not reverse-engineer, decompile, or attempt to extract the source code of the app.
• You may not use the app to transmit harmful, illegal, or offensive content, or to distribute malware or spam.

6. Subscription Terms

PlanEat offers a free tier with limited features and a paid subscription ("PlanEat Pro") with additional features.

• Subscriptions are managed through Google Play (Android) or the Apple App Store (iOS) via RevenueCat.
• Billing is handled entirely by the respective platform (Google or Apple). PlanEat does not process payment information directly.
• Subscription prices are displayed in the app before purchase and may vary by region.
• Cancellation, refunds, and renewal policies are governed by the platform where you made the purchase:

• We reserve the right to change subscription pricing. Existing subscribers will be notified before any price change takes effect.

7. Intellectual Property

• The PlanEat name, logo, design, and code are owned by the Data Controller. All rights reserved.
• You retain full ownership of the data you create within PlanEat (meal plans, food entries, grocery lists).
• By using PlanEat, you do not receive any license to our intellectual property beyond the right to use the app as intended.

8. Limitation of Liability

To the maximum extent permitted by Italian and EU law:

• PlanEat is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.
• We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the app, including but not limited to: data loss, inaccurate nutritional estimates, or health consequences.
• Nothing in these terms excludes or limits liability that cannot be excluded under applicable law, including liability for fraud or gross negligence.

9. Indemnification

You agree to indemnify, defend, and hold harmless PlanEat, its creator, operators, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your access to or use of the app, your violation of these Terms, or your violation of any rights of another.

10. App Store and Google Play Store Additional Terms

If you download the app from the Apple App Store or Google Play Store, the following terms apply:

• These Terms are concluded between you and PlanEat, not with Apple Inc. ("Apple") or Google LLC ("Google"). PlanEat, not Apple or Google, is solely responsible for the app and its content.
• Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the app.
• In the event of any failure of the app to conform to any applicable warranty, you may notify Apple or Google, and they may refund the purchase price for the app (if applicable). To the maximum extent permitted by applicable law, Apple and Google will have no other warranty obligation whatsoever with respect to the app.
• Apple and Google are not responsible for addressing any claims by you or any third party relating to the app, including product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• Apple and Apple's subsidiaries, and Google and Google's subsidiaries, are third-party beneficiaries of these Terms, and have the right to enforce these Terms against you.

11. Termination

• You may delete your account at any time through the app (Settings > Delete Account). This will permanently remove all your data.
• We reserve the right to suspend or terminate your account if you violate these Terms of Service.
• Upon termination, your right to use the app ceases immediately.

12. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of Italy.

Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Italy, without prejudice to the mandatory consumer protection provisions of EU law that may apply in your country of residence.

If you are an EU consumer, you may also use the EU Online Dispute Resolution platform.

13. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the app after changes constitutes acceptance of the revised terms. For material changes, we will notify you through the app or by email.
